Vince Bhachu lost both civil and criminal proceedings against him in court for selling a dangerous car
both court hearings were held in Birmingham, UK
Deal with him at your peril

JUST TO POINT OUT

I Vince Bhachu PLEADED GUILTY and was not FOUND GUILTY, there is a big difference there. I admitted to my mistakes and did not RUN away from it all.

Even though the case has just ended after a year, and me offering a refund to the YIP family several times.

I can confirm that I sold a 18 year old 75 3.0 V6 with 8 months MOT for 800.00 gbp, but due to further inspections from trading standards and so called non Alfa independant inspectors, they found that the car had suffered from sill and jacking point corrosion as well as small minor Typical alfa defects the car was proven to be "unroadworthy" under the road trafic act 1988. Hence there is NO defence to this act by any lawer or barrister.

After receiving quotes, the cost of the total repairs to make this car road worthy again was 650.00 gbp plus 350.00 labour compared to the exagerated amount by a rip company of 3000.00 gbp called Boardwater Classics.

I am still looking forward to the return of the car so I can file a case against the Ministry of Transport, the POLICE and also VOSA (vehicle on line services association) and NOT take it further action from the poor person I purchased the car from end of 2006 as this would not be fair.

If you buy an Alfa Romeo and don't have it inspected prior to money changing hands, you are a fool. The only thing worse than that is somebody trying to make up for their stupidity by suing somebody else.

I have always had good experiences dealing with Vince.

800 pounds!!!? ! christ you can only just about get a scrap 75 V6 for that. buy a 75 in the UK for that, and you can bank on it being swiss cheese underneath..no matter how many certificates it has.. anyone who knows alfas knows that.

Here below is our UK law regarding "unroadworthy Vehicles", it must be pointed out, that in some countries e.g France, their MOT's or ITV's are every 2 years, god help 20 year old Alfa's, poor cars would not stand a chance. Car was sold for a racing project by the way and still had eight months MOT remaining and sold for 800.00 gbp.

Their is no defence to this LAW.


75 Vehicles not to be sold in unroadworthy condition or altered so as to be unroadworthy (1) Subject to the provisions of this section no person shall supply a motor vehicle or trailer in an unroadworthy condition.
(2) In this section references to supply include—
(a) sell,
(b) offer to sell or supply, and
(c) expose for sale.
(3) For the purposes of subsection (1) above a motor vehicle or trailer is in an unroadworthy condition if—
(a) it is in such a condition that the use of it on a road in that condition would be unlawful by virtue of any provision made by regulations under section 41 of this Act as respects—
(i) brakes, steering gear or tyres, or
(ii) the construction, weight or equipment of vehicles, or
(iii) the maintenance of vehicles, their parts and accessories in such a condition that no danger is or is likely to be caused, or
(b) it is in such a condition, as respects lighting equipment or reflectors or their maintenance, that it is not capable of being used on a road during the hours of darkness without contravention of the requirements imposed by law as to obligatory lamps or reflectors.
(4) Subject to the provisions of this section no person shall alter a motor vehicle or trailer so as to render its condition such that the use of it on a road in that condition would be unlawful by virtue of any provision made as respects the construction, weight or equipment of vehicles by regulations under section 41.
(5) A person who supplies or alters a motor vehicle or trailer in contravention of this section, or causes or permits it to be so supplied or altered, is guilty of an offence.
(6) A person shall not be convicted of an offence under this section in respect of the supply or alteration of a motor vehicle or trailer if he proves—
(a) that it was supplied or altered, as the case may be, for export from Great Britain, or
(b) that he had reasonable cause to believe that the vehicle or trailer would not be used on a road in Great Britain, or would not be so used until it had been put into a condition in which it might lawfully be so used, or
(c) in the case of a vehicle or trailer the supply of which is alleged to be unlawful by reason of its condition as respects lighting equipment or reflectors or their maintenance, that he had reasonable cause to believe that the vehicle or trailer would not be used on a road in Great Britain during the hours of darkness until it had been put into a condition in which it might be so used during those hours without contravention of the requirements imposed by law as to obligatory lamps or reflectors.
(7) Nothing in the preceding provisions of this section shall affect the validity of a contract or any rights arising under a contract.

whether Vince Bhachu pleaded guilty or was found guilty is of no consequence, He IS GUILTY of breaching both civil & criminal law
If Vince had indeed sold the vehicle for a racing project and had stipulated that on a contract of sale then Vince would have a defense but to sell a vehicle with an MOT certificate is to state that the vehicle is fit for Road use under UK law and therefore constituted an offense
Under UK law, where the seller inspects or not does not exempt the seller from their obligations
I personally went to meet Vince & speak with him regarding this car with Mr Yip, I am still in touch with Mr Yip & other witnesses
While Mr Bhachu did come across in a pleasant manner, this still does not exempt him of the fact that 2 court rulings stand against him due to his breach of the law
Was it an unfortunate mistake? malicious sale?, I dont know, I have been in contact with others who state they had been sold unsuitable goods by Vince Bhachu
I state these facts without prejudice to Vince Bhachu, however knowing what I do, I would not personally deal with Vince as a buyer ever
I could not in good conscience encourage any other person to do so either
The fact remains that 2 court rulings of the Courts of the UK remain against Mr Vince Bhachu
Mr Bhachu has of course the legal right to challenge said rulings, though I am not aware of any Judicial review or appeal process in either case

To clarify about Broadwater Classics

The repair costs given by Vince are Quotes, Estimates, Best guess if you like
Shopping around will give differing prices
Broadwater Classics were a specialist company who did maintenance work on classics including performance cars such as Ferrari
As such the report from Broadwater may well represent the upper end of the scale, though it would also represent premium grade repair work
This their price quoted was an estimate by seasoned professionals who had a reputation for excellence
As far as I am aware the Company Broadwater is no longer trading, I believe the partners have moved on to other projects
By way of comparison, you can get web sites designed cheaply from many vendors, though if you ask my company you will get a higher than average quote, this represents the fact that we develop premium grade multi-lingual web sites, not mono-lingual template based basics
Go to a back street knock shop you get back street prices, goto Silverstone & deal premium you get the quality & price which reflects this

I am not saying that Vince rips off everybody, what I am saying is that in the Case of Mr Yip & the car in question, Vince lost claims against him in a court of law
I am happy to hear that others have had good experience & perhaps this stinging experience will encourage Vince to be more diligent in his future dealings

The price £8 or £800 is not the issue, road safety in this case is, if Vince was advertising & selling the car without an MOT & stating it needed work to make it roadworthy, there would have been no case, but HE did sell it with an MOT & it was sold as roadworthy, which clearly IT WAS NOT, a fact supported by 2 court rulings
The buyer may have been a little optimistic about the bargain he thought he was getting but that does not change the fact, Vince sold under the pretext that the car was roadworthy, it clearly was NOT
I personally bought an Audi 80 for £400, it was fine, no safety issue, no rust issue & was just as old so maybe we should all drive Audi instead, sounds like a better deal than an Alfa if I am expected to get nothing but rust for £800

A resercher by the name of Grant of Top Gear contacted me about purchasing an Alfa 75 3.0 V6 for their programme shown 3 weeks ago........he was after a 75 3.0 in any condition rust ot without for under 1000.00 pounds with an MOT. They clearly knew what to expect from an Alfa especially a 20 year old car as Jeremy Clarkson is a true alfa enthusiast himself.

His words were " Alfa's are solely purchased by enthusiasts and in order to buy such a vehicle, they have previously owned or have vast knowledge and experance of these fine thoroughbreds"

Otherwise do not buy an Alfa before you have done your research or join the AROC or vist a smiliar website to this one for more information.

It's funny how prople like IVAN (a non Alfa person) join these sites well after the event to criticize and bad mouth people especially when they know sod all about Alfa's and drive crap like Rover's and Audi's.

You gotta be a serious idiot if you think you gonna get a rust free Alfa for 800# which has spent its life(20 years) in European conditions. Our cars here in SA have never seen snow and they still get rust in pannels that have not been cleaned or maintained.

Probably doesn't have to be rust-free to have MOT, although I'm no expert. I agree that the buyer may have had unrealistic expectations, but I suppose the law is the law.

Jes, true thats why the law is there BUT they would have to make a new law for state of mind for a non Alfisti buying a cheap old Alfa !! If you not an Alfa freak your better off buying a newer more modern less character jap car.
